ANALIZA PREDMETA MUCKO PROTIV RH
U ovom izrazito značajnom predmetu Mucko protiv Hrvatske br. 55588/18, koji nažalost nije objavljen u sudskoj praksi Europskog suda za ljudska prava jer je okončan priznanjem povrede od strane RH i isplatom naknade podnositelju, zauzeta su stajališta koja su dijametralno različita od dosadašnje prakse sudova u RH i Ustavnog suda RH, a odnose se na pravo stranke na naknadu troškova zastupanja po odvjetniku u upravnom postupku.

JUDGMENT OF THE EUROPEAN COURT OF HUMAN RIGHTS: KOVAČEVIĆ v. CROATIA
Our team participated in another success before the European Court of Human Rights in the case of Kovačević v. Croatia.
European Court of Human Rights on May 12 2022 in a majority of 5 judges, ruled that there had been a violation of Article 6 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms in the applicant's case, namely a violation of the right to a fair trial for failure to adjudicate the costs of the constitutional proceedings.
