ANALYSIS OF THE JUDGMENT IN GOGIĆ v. CROATIA

On 8 October 2020, a judgment was delivered by which the Court found a violation of Art. 6 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

The judgment found that, owing to the erroneous legal qualification and the instruction given to the applicant by the lower courts, as a result of which his claim for damages had become time-barred, his right of access to a court, guaranteed by the Convention, had been violated.
